These Terms of Service (“Terms”) govern your use of C&S Construction’s website, communications, and services (collectively, the “Services”). By contacting us, requesting an estimate, signing a proposal/contract, or otherwise using our Services, you agree to these Terms.

SMS/Text Messaging Use Cases
If you opt in to receive SMS/MMS text messages from C&S Construction, we may use text messaging to communicate with you about estimates, scheduling, your project, and our services. Text messages may include:
Carrier NOT responsible for messaging.
Estimate communications (request confirmations, follow-ups, clarifying questions, quote delivery)
Scheduling and appointment coordination (site visits, start dates, crew arrival windows, reschedules, cancellations)
Project updates (milestones, progress notes, change order confirmations, material delays, completion updates)
Account and billing notices (invoices, payment reminders, receipts, balance confirmations)
Customer support and two-way messaging (answering questions, collecting details/photos, service requests)
Safety and urgent notifications (weather delays, site access issues, time-sensitive updates)
Promotional messages (special offers, seasonal promotions, new services, and limited-time deals, only if you opted in)
Message frequency may vary. Standard message and data rates may apply. You can opt out at any time by replying STOP, and you can request help by replying HELP.
Eligibility (18+). By opting in to receive text messages, you confirm that you are 18 years of age or older (or that a parent/legal guardian has provided consent on your behalf where permitted by law).
1) Definitions
“Company,” “we,” “us,” “our” refers to C&S Construction.
“Client,” “you,” “your” refers to the person or entity requesting or receiving Services.
“Project” means the work described in a written estimate, proposal, scope of work, work order, or contract.
2) Scope of Services
We provide construction-related services which may include (but are not limited to) remodeling, additions, barndominiums, repairs, and related labor/material coordination. Specific deliverables, materials, timelines, and pricing must be confirmed in writing.
Any drawings, measurements, photos, or descriptions you provide are relied upon for estimates and planning. You are responsible for providing accurate information.
3) Estimates, Proposals, and Changes
Estimates are non-binding until accepted in writing and may be subject to change due to site conditions, material availability, price changes, or scope adjustments.
Change Orders: Any change to the Project scope, materials, design, schedule, or site conditions may require a written change order and may affect price and completion time. We are not obligated to perform changes without written approval.
4) Scheduling and Delays
Project start dates and completion timelines are estimates unless expressly stated as guaranteed in writing.
Delays can occur due to factors outside our control, including permitting timelines, inspections, weather, material/labor availability, concealed conditions, homeowner decisions, or third-party vendors. C&S Construction is not liable for delays caused by these factors.
5) Permits, Approvals, and Utilities
Unless stated otherwise in writing:
You are responsible for ensuring the Project is permitted/approved as required by local authorities and homeowner associations (HOAs).
If we agree in writing to obtain permits, permit costs and related fees are the Client’s responsibility unless included in the contract price.
You agree to provide safe access to the jobsite, working utilities (water/electricity), and a reasonably clear work area.
6) Site Conditions, Access, and Safety
You agree to provide:
Access to the property during agreed working hours.
Disclosure of known hazards (e.g., asbestos, mold, structural issues, buried lines, septic systems).
A safe environment for our crew, subcontractors, and visitors.
We may pause work if we determine conditions are unsafe or if necessary information is withheld.
7) Materials and Substitutions
Material selections, brands, colors, and finishes should be confirmed in writing. If a specified material is discontinued, backordered, or unavailable, we may propose a reasonable substitute. Price differences may be addressed through a change order.
8) Payments
Payment terms are defined in your written agreement (estimate, invoice, contract, or proposal). Unless otherwise stated in writing:
Deposits may be required to schedule labor and order materials.
Progress payments may be due at milestones.
Final payment is due upon substantial completion or as stated in the contract.
Unpaid balances may result in work stoppage, rescheduling, late fees (if permitted), and collection efforts.
9) Cancellations and Work Stoppage
If you cancel a Project after acceptance or after work/material ordering has begun, you are responsible for:
Work performed to date,
Materials ordered or delivered,
Restocking fees, and
Reasonable administrative costs.
If the Project is paused due to Client delay (e.g., selections not made, access not provided, non-payment), the schedule may be reset and additional costs may apply.
10) Inspections, Punch Lists, and Acceptance
You agree to conduct a walk-through when requested. Minor touch-ups and completion items may be listed in a “punch list.” Final payment remains due as stated in the agreement, even if minor punch list items remain, unless your contract states otherwise.
11) Warranty
If we provide a workmanship warranty, the terms and duration will be stated in writing. Unless otherwise stated:
Warranty coverage generally does not include normal wear and tear, abuse, improper maintenance, damage caused by others, Acts of God, or issues resulting from materials provided by the Client.
Manufacturer warranties (if any) apply to products/materials and are governed by the manufacturer’s terms.

12) Client Responsibilities
You agree to:
Make timely decisions on selections and approvals.
Keep pets, children, and non-essential visitors away from work zones.
Remove or protect valuables in and around the jobsite.
Maintain adequate property insurance.
13) Photos, Marketing, and Reviews
We may take before/after photos or videos of Projects for documentation, quality control, and training. With your permission (written or via clear confirmation), we may use non-identifying images for marketing (website, social media, portfolio). You may opt out at any time by emailing us.
14) Communications (Calls, Texts, Email)
By contacting us, you consent to receive communications related to estimates, scheduling, and your Project via phone, text message, or email. Message/data rates may apply. You can opt out of promotional texts at any time by replying “STOP” (if applicable) or emailing us.
15) Limitation of Liability
To the maximum extent permitted by law:
C&S Construction is not liable for indirect, incidental, special, consequential, or punitive damages.
Our total liability for any claim related to the Services will not exceed the amount you paid us for the portion of Services giving rise to the claim.
Some states do not allow certain limitations, so these may not fully apply to you.
16) Dispute Resolution
If a dispute arises, you agree to first contact us to attempt resolution in good faith. If not resolved, disputes will be handled in accordance with applicable Texas law, and venue will be in a court of competent jurisdiction in Texas, unless otherwise required by law or agreed in writing.
17) Right to Refuse or Terminate Service
We may refuse or terminate Services if:
The jobsite is unsafe,
You fail to pay per the agreement,
There is harassment, threats, or abusive conduct toward our team, or
You request work that violates code, law, or safety standards.
18) Website Use (If Applicable)
If you use our website:
Content is provided for general information and may change without notice.
You agree not to misuse the site (spam, hacking, scraping, unlawful activity).
Intellectual property (logos, text, photos) belongs to C&S Construction unless otherwise stated.
19) Changes to These Terms
We may update these Terms periodically. Updated Terms become effective when posted or provided. For active Projects, the signed written agreement governs in the event of conflict.
